Rulemaking - WAC 173-400/401 and Source Test Manual

Ecology is seeking informal public comments on the following actions:


  • Draft amendments to two air quality rules


  • Chapter 173-400 WAC, General Regulations for Air Pollution Sources
  • Chapter 173-401 WAC, Operating Permit Regulation


  • Draft updates to Ecology's 2004 Source Test Manual - Procedures for Compliance Testing


Amendments to Chapter 173-400 WAC will incorporate an updated version of the Source Test Manual and update the rule's adoption date to adopt by reference applicable federal rules in effect at that time.


Amendments to Chapter 173-401 WAC will repeal the affirmative defense provisions to align with EPA's July 2023 rule that repealed those provisions in Title V of the federal Clean Air Act.


Updates to the 2004 Source Test Manual will update dates and remove outdated source testing methods.
